Marriage licenses continue during shutdowns

During a federal shutdown, if the Clerk stops issuing licenses, the Mayor issues licenses and can authorize officiants. The Mayor uses a Mayor-created license form, similar to the Clerk’s form. Completed licenses can be returned to the Clerk or to the Mayor. The Mayor keeps sealed copies and record books. Mayor-issued licenses are numbered from 1 with a letter prefix. Within 5 business days, the Mayor sends a true copy to the Clerk. The Clerk’s certified copy is official proof of marriage.

Mayor's marriage role only in shutdowns

The Mayor can issue licenses or authorize officiants only when a federal shutdown stops the Clerk from issuing licenses. Outside a shutdown, only the Clerk issues licenses and authorizes officiants.

Shutdown fix lasts 225 days

This law takes effect after mayoral approval or a Council veto override and a 30-day congressional review. It expires 225 days after it takes effect.
