The law requires public reporting and an overcrowding plan for District of Columbia youth detention facilities. Requirements apply when the law’s fiscal effect is included in an approved budget and financial plan. The youth services department must post data for the Youth Services Center and New Beginnings Youth Development Center online. Reports include daily population counts by entry status, race, and age, plus average length of stay. Monthly Youth Services Center data must count youth admitted with committed status or changed to that status. Reports must also show committed youths’ average days confined at release, grouped by month of admission or status change. Monthly reports cover improper room confinement, including confinement over six hours, and critical incidents and assaults by type and facility. At 12-, 24-, and 36-month intervals, reports must show new-offense rates for the first 12 months after release from out-of-home committed placement. These include new charges, delinquency findings or convictions, and commitment or incarceration for a new offense. Within 120 days after applicability, the Mayor must submit a one-year action plan to the Council. It must address Youth Services Center overcrowding and youth awaiting placement. The plan must explain how the department will permanently keep the population at or below maximum capacity and prevent future overcrowding.
