Temporary energy-rule relief for building projects

The DC law exempts listed nonresidential projects from maintaining net-zero energy compliance. These include temporary buildings, additions under 10,000 square feet, police, fire, emergency response, and Office of Unified Communications facilities. Indoor swimming pool facilities, called natatoriums, also qualify. Another exemption covers projects with all construction-start permits submitted before October 1, 2024, and no submission to GBAC before March 1, 2026. Listed public-safety facilities and aquatic centers containing natatoriums also get relief from energy conservation and energy supply standards. That added relief lasts until the Mayor’s final regulations take effect. The act expires 225 days after taking effect.

Energy rules for construction and renovation projects

The law applies covered building requirements to new construction and renovations classified as “Level 3 alterations” by the Building Codes. “Level 3 alteration” replaces “substantial improvement” as the renovation trigger in the two building laws. Buildings subject to net-zero standards must obtain the renewable energy amount set by the latest Appendix Z energy standards. They must generate renewable energy on-site wherever feasible and maintain compliance with the on-site fuel restriction. That restriction bars burning fuel on-site for heat, except for backup power generation. These amendments expire 225 days after the act takes effect.
