This emergency law takes effect upon the Mayor’s approval or a Council veto override. It remains in effect for up to 90 days.
The law lets the Mayor enter and fix a private alley or right-of-way the city uses for regular trash pickup. The city can act only when the way is not in good repair for trash trucks and the owner is not already required to maintain it for the city. The owner must consent and provide a release of liability and indemnify the city. Before work starts, the Mayor must try to get releases and indemnifications from every affected owner. The Mayor may set terms and conditions as part of the repair.
