Affidavit transfers without opening probate

Heirs and small-estate claimants can transfer property by affidavit even if no will is admitted to probate. This lets assets move without starting a formal probate case when it is not needed. It saves time and reduces paperwork for families.

Faster appointment of personal representatives

The Register of Wills or the Court can now issue letters of administration and appoint personal representatives. If the Register finds a petition insufficient, a judge can review it and appoint someone. The law also restores missing probate wording so staff and judges follow the same rules. These changes shorten delays and make it easier to access estate assets.

Clear start date for new probate rules

The law applies when the person died on or after March 21, 2025. Estates with that date can use the Act’s streamlined probate steps. If the death was before that date, the prior rules apply.
