Late disability claims for brain-injured officers

Public safety officers or their legal guardians can apply to the Georgia State Indemnification Fund despite missing the usual deadline. The special application window runs from July 1, 2026, through August 1, 2026. Officers must have total permanent disability from organic brain damage suffered on duty on or before July 1, 2024. Extended recovery must have prevented them from applying on time. Applications must include proof required by the Department of Administrative Services, which sets documentation and claim procedures. This special rule is repealed July 1, 2030; the application window still ends August 1, 2026.

Required benefit notices for injured officers

Beginning July 1, 2026, Georgia's State Board of Workers’ Compensation must notify injured employees or their legal guardians about officer benefits. This applies when the board has reasonable cause to believe the employee is an eligible peace officer. The board must also notify the Department of Administrative Services. Law enforcement agencies must notify employees or guardians when they reasonably believe the employee may qualify as a peace officer. Agency notices are due within 10 days after an injury that may cause temporary or permanent disability. Notices must include contacts for the Georgia State Indemnification Fund and temporary disability compensation program, plus information required by department rules. These notices do not guarantee benefits.
