Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Lower cash deposit cap for bail companies

Professional bail companies qualify after operating continuously in a county for at least 18 months. Their maximum required cash escrow deposit drops from $1 million to $500,000. Required cash escrow or other collateral also remains capped at 5% of current outstanding bail bond liability.

Family cash bonds escape yearly limits

An individual posting a cash bond for an immediate family member is exempt from the three-bonds-per-year limit in each jurisdiction. The same exception removes the charitable bail fund requirements in that paragraph. It applies only to an individual posting for an immediate family member, not an organization.

Stronger notice rights for accused people

Before an arrest warrant hearing, officials must try to notify the person whose arrest is sought. They must use personal service or another judge- or officer-approved method likely to convey the hearing’s date, time, and location. The exception in Georgia Code Section 17-4-40(b)(6) still applies. In criminal arrest warrant proceedings, accused people must receive personal service of the specific charge and its basic details.
