Fulton County changes district board elections

The law changes board election and vacancy rules for community improvement districts in unincorporated Fulton County. When an elected seat opens, remaining members must appoint a district elector by majority vote within 60 days. The appointee serves only until the next regular election, regardless of the seat's remaining term. No more than two board-appointed members may serve at once. If another vacancy opens while two appointees serve, the board must call a special election within 60 days. That election must occur within 60 days after the call and fill the seat's remaining term. A special election is optional when the vacancy occurs within 180 days of the next regular election. Special election notices must appear in the county's legal newspaper at least 45, 31, 17, and 10 days before voting. Electors must also receive U.S. mail notice at least 31 days before voting, using property-roll addresses. Initial election meetings must occur within 60 days after the required resolutions are adopted and written consents obtained. Later election meetings occur every two years, within 60 days after the county's property tax return filing deadline. These meetings fill expiring terms and vacancies. County commissioners set election meeting times and places and provide newspaper and mailed notices; the initial meeting must be within the district.
