The law defines when the mayor’s or a council seat is empty. A vacancy exists if the official resigns, dies, moves out of the city, is ruled incompetent, or is convicted of malfeasance, a felony, or an election crime. It also exists after four straight missed regular meetings unless the council grants a leave and records it in the minutes. If a council seat opens with fewer than 12 months left, the mayor appoints a replacement, subject to approval by a majority of the remaining council. If 12 months or more remain, or if the mayor’s office opens, voters choose the successor at the next special election under Georgia’s election code.
