Doraville sets rules for replacing elected officials

The law sets rules for vacancies in Doraville’s mayor and city council offices. An office becomes vacant when its holder resigns, dies, moves outside the city, or is found legally incompetent. Missing four consecutive regular meetings also creates a vacancy unless the council grants leave and records it in the minutes. Conviction for wrongdoing in office, a felony, or an election-law violation also creates a vacancy. With fewer than 12 months left in a council term, the mayor appoints a replacement for the remaining term. A majority of the remaining councilmembers must approve that appointment. With more than 12 months left, voters fill the council seat at the next available special election date. Every mayoral vacancy is filled at the next available special election date, regardless of time left in the term. These elections follow Georgia’s Election Code. The law does not specify how to fill a council vacancy with exactly 12 months left.
