Georgia excludes qualifying drugs containing lysergide tartrate or crystalline polymorph psilocybin from Schedule I. Each drug must receive FDA approval under Section 505 of the federal Food, Drug, and Cosmetic Act. It must also match its DEA scheduling and be listed in the federal Controlled Substances Act. The exceptions take effect only when these federal actions occur, with no fixed calendar date. They do not guarantee drug availability or insurance coverage.
Pharmacies no longer need specified numbers of certified technicians when a pharmacist supervises three or four or more technicians. Certification remains available through a Board-approved program, Board-approved employer training and assessment, or a Board-approved national certifying body. One pharmacist may directly supervise up to six pharmacy interns and externs in any combination. This replaces the prior limit of one intern and one extern; direct supervision remains required.
Wholesale drug distributors must provide prompt full credit or replacement for returned outdated drugs. This protection lasts up to six months after the labeled expiration date. The Georgia Board of Pharmacy may exempt drugs it lists as essential to healthcare treatment. Exemptions are no longer limited to drugs that expire less than one year after manufacture. The law does not guarantee lower retail drug prices.
The law broadens which pharmacy support workers count as technicians, including work outside a pharmacy. Technicians prepare drugs without using professional judgment, under a pharmacist’s supervision and responsibility. A pharmacist must be physically present and personally supervise technicians in the pharmacy’s licensed area. One pharmacist may directly supervise no more than four technicians there; remote technicians do not count toward that ratio. The Georgia Board of Pharmacy may approve higher ratios for hospital or closed-door pharmacies after their pharmacist-in-charge applies in writing. The Board sets rules for remote technician work and maintains a technician registry.
