The law sets election and appointment rules for Muscogee County school board vacancies. The timing cutoff uses the general election before the election for a successor’s new full term. For vacancies occurring more than 90 days before that earlier election, voters fill the remaining term through a special election. That special election takes place on the same date as the earlier general election. Remaining board members appoint an interim member by majority vote until the elected member takes office. For vacancies occurring 90 days or fewer before that election, a majority-vote appointment fills the rest of the term. Anyone elected or appointed must meet the qualifications for a full term. Voting takes place in the part of the district represented by the seat, or districtwide for a districtwide seat. The county election superintendent must call the special election within 30 days after the vacancy exists. Special elections must follow Georgia election law, and conflicting laws are repealed.
