New refund protections for Georgia investors

Georgia’s securities commissioner can order refunds for violations of Code Sections 10-5-50, 10-5-51, or 10-5-54. This covers people who commit or materially help those violations. Refunds include the principal paid for securities purchases and all money collected in connection with those purchases. The commissioner can also order violations to stop and deny, suspend, revoke, or limit broker-dealer and investment-adviser exemptions. Orders take effect when served, and recipients must receive notice of their right to request a hearing within 30 days. An order becomes final automatically if no hearing is requested or ordered within that period. Hearings follow Georgia’s Administrative Procedure Act, protect due process, and require final orders to state factual findings and legal conclusions. Final orders can impose penalties up to $50,000 for one violation or $500,000 for multiple violations, plus actual investigation or proceeding costs. If the deadline to seek court review passes, the commissioner can file a certified order in court for enforcement as a judgment. For noncompliance, courts can enforce orders without a bond and impose civil contempt penalties of $5,000–$50,000 per violation, plus other appropriate relief.

Simpler roof contracts for public agencies

For contracts entered into on or after the law’s effective date, existing-roof improvements are excluded from public works construction. Extra items placed on the roof are not covered by that exclusion. Notice and competitive award requirements count as satisfied when agencies select an approved, state-authorized supplier. That supplier must have approval from a cooperative purchasing organization and authorization from Georgia’s Department of Administrative Services.

Roof grants for eligible Georgia schools

Georgia school systems that qualify under Code Section 20-2-262(d) receive low-wealth capital grants to improve existing roofs. The work must appear in the system’s most recently approved local facilities plan. The supplier must be approved by a cooperative purchasing organization and authorized by Georgia’s Department of Administrative Services. The provided text does not specify grant amounts.
