Forsyth commissioner limits require voter approval

The law requires a Forsyth County vote on commissioner term limits on November 3, 2026. Approval requires more than half the votes cast on the measure. With approval, the limits take effect January 1, 2027, and cover people elected after that date. After two full terms, commissioners cannot be elected to a successive term until four years after their last term ends. Earlier service counts toward the limit. Without approval, or if the election is not held as required, the limits do not take effect. The act then automatically repeals 365 calendar days after the scheduled election date. The county pays election costs, and election officials must publish the date and purpose in the county’s official newspaper for two weeks beforehand. They must also certify results to Georgia’s Secretary of State. These election duties are mandatory, and any voter can ask a court to force compliance. If officials fail to comply, the court must require the election on the mandated date or next legally allowed special-election date.
