Hawaii condo associations must put all required details in the budget summary, not point owners to other parts of the budget. The summary must show estimated income and expenses, how the budget was prepared, the reserve fund balance, and the amount to collect for replacement reserves. It must explain the reserve study, including who prepared or reviewed it, any conflicts or omitted property, planned increases over 30 years, and any prior-year shortfall and its effect on future assessments. A study not prepared by an independent preparer must be reviewed independently at least every three years. The summary must also state whether a percent-funded or cash-flow plan was used; that method cannot override the study. For buildings in counties with more than 500,000 people, it must show estimated costs for qualifying fire-safety equipment or installations; the study may forecast a loan or special assessment to pay for them.
A condo unit owner who belongs to the association can sue over an alleged violation of these budget and reserve rules. The owner can ask a court to order the association’s board to comply. An association, entity, or person that makes a good-faith effort to estimate replacement-reserve assessments is not liable solely because the estimate later proves wrong.
