Beginning July 1, 2026, Hawaii allows outside historic-preservation reviews for residential or majority-residential mixed-use projects needing permits or other approvals. If the department determines it cannot respond within 60 days, it must hire a qualified reviewer by that deadline. The reviewer must recommend an outcome within 30 days of being hired. Reviewers must meet state education and experience standards, follow ethics rules, and avoid projects they or their employers previously worked on. The department can end contracts for inaccurate reviews or failure to follow preservation laws or rules. Projects requiring federal review under section 106 of the National Historic Preservation Act are excluded. This authority ends June 30, 2030, when the prior statutory language is restored.
Beginning July 1, 2026, project applicants must pay reasonable fees when the state hires outside reviewers through this process. The law sets no dollar amount. Applicants can arrange fee payment through contracts or sponsorship involving counties, housing authorities, nonprofits, or others. This fee requirement ends with the temporary review program on June 30, 2030.
