Establishes that for a minor in theatrical employment with a gross income of at least $5,000 on a project or $20,000 in a calendar year: a parent or legal guardian of the minor is required to establish a trust account for the minor with an independent third-party trustee; and the employer of the minor is required to deposit a portion of the minor's earnings into the trust account until the minor becomes an adult. Makes misappropriation or fraudulent use of funds within the trust account a breach of fiduciary duty subject to penalties. (CD1)

Hawaii requires trusts for child performers earning at least $5,000 per project or $20,000 in a calendar year. Covered work includes modeling, dancing, singing, music, social media influencing, entertainment, and film, television, radio, or stage performances; government employers are excluded. Parents or guardians must open the trust before the first theatrical job and maintain it until transfer to the child or their estate. Employers must deposit at least 15% of gross earnings until adulthood or emancipation, protecting savings but leaving less available immediately. An independent trustee must protect and grow the funds and send quarterly statements to the child and parent or guardian. At least one parent or guardian must sign employment contracts, and parents or guardians can access trust money only for the child’s benefit. Misappropriation or fraudulent use by parents, guardians, or trustees is a breach of their legal duty and is subject to civil penalties and criminal prosecution; trustees also face removal. The law took effect upon approval and leaves previously established rights, duties, penalties, and proceedings unchanged.
