Beginning July 1, 2026, Hawaii creates a faster county permit path for single-family and multifamily housing. Applicants can request it after 60 business days without full county approval, counted from when the application was deemed complete. Counties must check requests for completeness within five days and identify missing information. Projects cannot exceed 30 feet and must show adequate infrastructure capacity. They must meet historic-preservation requirements through professional certification or completed state review. Projects in FEMA A or V flood zones need a county floodplain development permit. Shoreline parcels and parcels affected by waves, high tides, or shoreline erosion are excluded. Plans must carry licensed professionals’ stamps certifying building-code compliance, and counties can set additional administrative requirements. Professionals must provide at least $2 million in insurance naming the State and county as additional insured, plus legal promises to cover their losses. Coverage must include the completed project for the period required by state law. For applications under section 444-2.5, owners instead waive claims against the State and county and promise to cover their losses. After an agreement with the licensed professional, the county accepts that professional’s approval and issues the expedited permit. The professional or county oversees construction compliance; professionals and contractors must fix defects identified by inspectors. Professionals must certify that occupancy requirements are met, and inspection records must go to the applicant and county after occupancy approval. Existing laws and county enforcement powers remain in place. Counties may charge program fees and adopt timing rules that account for waits for substantive responses or revisions. The program expires June 30, 2031.
