The board extends timelines when a mandamus petition or appeal is pending. It may move a vote between the June 1–Nov. 1 window and the 365–270-day window so the case can finish first. The board must adopt rules under chapter 17A that set procedures and timelines, including how it will extend timelines and reschedule votes.
Before a vote, the board sends written notice to the employer and the union. Within 10 days, the employer must give the board a list of unit employees. The board uses the list to set who can vote and to count results. After the 10 days, the board posts on its website the employers with pending votes and names any that missed the list. Within 60 days after that first posting, any Iowa resident can ask a district court or Polk County to order the list. The court speeds the case, must grant the writ if the employer failed, and awards court costs and reasonable attorney fees to the winner.
The employment appeal board runs a vote to keep and recertify your bargaining representative before your contract ends. If your contract expires June 30, the vote happens between June 1 and Nov. 1 of the prior year. For other end dates, the vote happens 365 to 270 days before expiration. The ballot asks whether to keep and recertify the representative. Starting May 19, 2026, these rules apply only when the board’s notice of intent is issued on or after that date.
