Beginning 07/01/2026, the Department cannot require a prospective adoptive parent to affirm or support policies on sexual orientation or gender identity that conflict with their sincere beliefs. It also cannot disqualify or refuse to consider an adoptive parent for those beliefs, and cannot make rules that do so. When deciding a placement, the Department may compare the child’s and family of origin’s beliefs with the prospective parent’s beliefs, consistent with the child’s best interests. Prospective adoptive parents can sue for violations, and courts may order relief and award attorney fees and costs. The Iowa Attorney General may also enforce these protections.
