Clear notice before agency hearings

Beginning July 1, 2026, agencies must send written notices when they offer a contested-case hearing. The notice must state the action, cite the law or rule, explain how to ask for a hearing, and give the deadline. For non-emergency hearings, all parties must also get notice with the time, place, type of hearing, the legal authority, and a short, plain statement of the issues.

Fairer, more accessible agency hearings

Beginning July 1, 2026, presiding officers must run hearings to bring out all relevant facts and allow needed cross-examination. All parties can respond and present evidence and arguments, unless limited by an order. Officers may hear nonparty statements, but parties can challenge them and ask that statements be sworn. The agency must record the hearing at its expense. A party may buy a transcript or make extra recordings if not disruptive. Hearings may be held by phone or video if everyone can take part live.
