Beginning July 1, 2026, flying a drone inside a prison’s restricted airspace is illegal. Restricted airspace runs from the ground up to 400 feet within the facility’s perimeter. Violations are misdemeanors with a $2,000–$5,000 fine or up to 1 year in jail, and the court must forfeit the drone. Drone pilots must know where prisons and restricted airspace are; saying you did not know is not a defense. The Department of Correction posts 'Drone No Fly Zone' signs on roads near prisons.
Beginning July 1, 2026, the Department of Correction and police can act against drones inside prison restricted airspace when they reasonably suspect illegal or harmful use. They can detect, track, identify, intercept, or disable a drone using legal and safe methods, like jamming, hacking, or physical capture. Agencies and officers are not liable if a drone is lost or damaged because of these actions.
