Limited lawsuits over directed transfusions

Beginning July 1, 2026, providers and hospitals are immune from lawsuits for harm from patient-provided blood used under this law. This protection applies when they act within their license. You can still sue if their gross negligence regarding the blood product or transfusion caused the harm.

Use your own or directed blood

Beginning July 1, 2026, you can arrange to use your own blood or a named donor’s blood for your transfusion. Providers and hospitals cannot block this when the blood comes from a center that follows all federal rules. They may refuse only if it would harm the donor or patient, there is not enough time to arrange it, or it is an emergency. The law defines covered blood products as whole blood, plasma, platelets, clotting agents, and blood derivatives. If state rules ever conflict with federal blood laws, federal rules control.
