Regular review of county jail costs

Beginning July 1, 2026, legislative committees review the costs of housing inmates in county jails every three years. This schedule began in 2004 and continues under this law.

State pays counties for state prisoners

Beginning July 1, 2026, the Idaho Board of Correction pays each county for people convicted, sentenced, and committed to state custody, including certain probationers and parolees held in county jail. Payment starts the day after the director gets notice the person is in custody. The state pays at least $80 per inmate per day for days 1–7, and $75 per day after day 7. The state also pays all ordinary and necessary medical and dental costs for these inmates. Sheriffs must bill at least every 60 days, and the Department pays within 60 days. The Legislature provides enough money each year to make these payments.

State and counties share jail liability

Beginning July 1, 2026, the state and each county share costs for damage or injury tied to housing state‑sentenced inmates. Each pays its share for harm caused by its own negligence or wrongful conduct. This does not change legal immunities under the Idaho Tort Claims Act.
