State sets flag display protocol

The Idaho Division of Veterans Services sets rules for where and how flags are displayed on state property. These rules guide the proper location and display of flags at state sites. The goal is a clear and consistent standard.

Fines and lawsuits for flag violations

A government that breaks these flag rules owes a $2,000 civil penalty per flag for each day it flies. Before suing, the Attorney General must send written notice and give 10 days to fix it, unless the government was warned before about a similar violation. If fixed within 10 days, no fines apply for that violation. If not fixed, the Attorney General can sue in the county’s district court to stop the violation and collect penalties from the first day. If the Attorney General wins, the court awards all of the Attorney General’s attorney fees.

Limits on flags at government sites

The law limits which flags a government entity in Idaho can fly on its property. Property includes buildings, parks, roads, and nearby land. Allowed flags are the U.S. flag; the government’s own flag; any U.S. state flag; city or county flags that existed before January 1, 2023; U.S. military and unit flags; the POW/MIA flag; flags of recognized tribes; and flags of Idaho colleges, universities, and public schools. A college or university flag counts only if the school has, by policy, named exactly one official flag. Foreign country flags are allowed only for special occasions and never for countries the U.S. is in hostile action with. Temporary parades or assemblies on government property are not bound by these limits. Schools, colleges, and universities are not treated as governmental entities under this law.
