New reckless driving rules start July 2026

The law takes effect on July 1, 2026. On that date, the updated reckless driving rules in Idaho Code 49-1401 apply. This sets when the new rules start and does not itself add new fines or benefits.

Speeding 20+ in school/work zones is reckless

Beginning July 1, 2026, driving over 20 mph above the limit in an active school or construction zone counts as reckless driving. This applies on highways and on public or private property open to the public. A first offense is a misdemeanor with up to 6 months in jail, a fine up to $1,000, or both. A repeat offense within 5 years is a misdemeanor with up to 1 year in jail, a fine up to $2,000, or both, and the state suspends your license under Idaho Code 49-326.
