Idaho Legislature can review court rules

Beginning July 1, 2026, the Idaho Legislature can review any court rules. This includes family law, juvenile, and court administrative rules. If it finds a conflict with Idaho Code or a rule that changes substantive rights, it must pass a House or Senate resolution to advise the Idaho Supreme Court. The Supreme Court still writes court procedure rules and cannot change anyone’s substantive rights. This sets a formal notice process and does not change taxes, benefits, or funding.
