Certificates of free sale for exporters

Beginning July 1, 2026, a "certificate of free sale" means your Idaho-grown or processed product is sold statewide and meets Idaho health and sanitary laws. Exporters can apply to the Department for a certificate and pay a fee set by the Department, capped at $100 per certificate. The Department may require your most recent state, federal, or third-party inspection records and keeps them for one year. A certificate does not remove any other rules you must follow. On July 1, 2026, the old IDAPA rules on these certificates are repealed.

New promotion programs and commodity mark rules

Beginning July 1, 2026, the Idaho Department of Agriculture can run voluntary promotion and certification programs for Idaho farm products. These programs are funded by fees paid by participants, deposited in the agricultural department inspection fund under section 22-105. Statutory commodity commissions and boards are the main owners of promotion and certification marks for their crops. You must have written permission to use those marks. Authorized groups can ask to join the department’s programs and may owe fees. In joint promotions, each party is responsible for its own negligence.
