Idaho presumes state control over local issues

Beginning July 1, 2026, Idaho law presumes the state controls matters inside Idaho. Federal officials must clearly show the U.S. Constitution gives them power to override the state. The law names core state areas: public health and safety; education; water and natural resources (not federal reserved rights); agriculture; energy; land use and zoning; and local economic rules. These examples are not a full list. Implied or incidental federal powers are read narrowly and cannot beat the state presumption. In any dispute, the Attorney General, the Governor, and the Legislature coordinate the state's response.
