Stronger bans on sexual contact in corrections

The law expands what counts as sexual contact, including many kinds of touching done to arouse sexual desire. It covers same- or opposite-sex contact. Prison and juvenile facility staff cannot have sexual contact with prisoners or juvenile offenders who are not their spouse. This applies whether the prisoner is in or out of Idaho. Supervising officers cannot knowingly have sexual contact with a parolee or probationer who is not their spouse. Violations are felonies. A conviction for contact with a prisoner or juvenile offender can bring up to life in prison. These rules take effect July 1, 2026.
