Felonies for illegal voting and interference

Beginning July 1, 2026, Idaho makes illegal voting a felony. Fraudulent voting by someone not entitled to vote, voting more than once in the same election, or handing in two or more ballots folded together are covered. The law also makes election interference a felony, such as changing or adding ballots to alter results. It is a felony to take or destroy poll lists, ballots, or boxes, detain or destroy returns, or block a fair, lawful canvass.

Felony for tampering with voting machines

Beginning July 1, 2026, tampering with a voting machine or vote tally system is a felony. The law covers interference with the machines or systems that record or count votes.

New election crimes take effect 2026

The law declares an emergency and takes effect on July 1, 2026. It repeals the prior Idaho Code section 18-2306 and enacts the new felony offenses in its place.
