Criminal penalties for opposite-sex restroom entry

Beginning July 1, 2026, it is a crime to knowingly and willfully enter a restroom or changing room marked for the opposite biological sex in a government building or a place open to the public. A first conviction is a misdemeanor punishable by up to one year in county jail. A second conviction within five years is a felony punishable by up to five years in state prison. Exceptions include custodial or maintenance work; giving medical aid; law enforcement help or supervising arrestees, detainees, or inmates; disaster or emergency aid or stopping a serious safety threat; using a single-user room for the opposite sex when it is the only facility reasonably available; using a restroom in dire need when no other facility is reasonably available; using spaces temporarily set for your biological sex; coaching or athletic training during events; helping a person who needs assistance if you are a family member or guardian, or their designee; and helping a minor who needs assistance when with a family member or guardian, or a designee who matches the room’s designated sex. For this law, a “changing room” means a place where people may be undressed with others, such as locker rooms and shower rooms.
