Beginning July 1, 2026, the department must write hemp rules that follow the 2018 Farm Bill. If a state rule is broader or stricter than federal law, the rule notice must clearly say which parts are broader or stricter. Rules under this chapter must use negotiated rulemaking, giving growers and processors a seat at the table. Once USDA accepts Idaho’s state hemp plan, Idaho hemp production, processing, transport, and research must also follow that plan.
Starting July 1, 2026, you can keep transporting industrial hemp across state lines to, from, or through Idaho. You must follow Idaho Code 67-2921 when moving hemp in interstate commerce.
Starting July 1, 2026, the agency must give notice and a hearing before imposing a hemp penalty. You can appeal a final penalty to the district court in the county where the violation is alleged. You must file within 30 days of the agency’s final action.
Beginning July 1, 2026, hemp producers are not treated as negligent if three things are true. You grow hemp only for grain or fiber, you make reasonable efforts to meet the acceptable THC rules, and your crop’s total THC is 1.0% or less on a dry weight basis. The department and the state hemp plan use these standards to judge compliance.
Beginning July 1, 2026, the Department can set fees and penalties for hemp law violations by rule. The law does not set the amounts; the agency will set them. Producers and handlers may face new costs once those rules are adopted.
