State approves 2026 Coeur d'Alene water deal

The law approves and confirms the 2026 Coeur d'Alene Tribe water rights settlement. Idaho executive agencies with duties under the deal must carry them out. The act is in force on and after its passage and approval.

Tribal water bank for off-reservation rentals

The law creates a Coeur d'Alene tribal water supply bank in the Coeur d'Alene-Spokane River basin. The Idaho Water Resource Board appoints a local rental committee to run it. The committee can rent tribal consumptive water rights, including natural flow and groundwater, between consenting owners and renters for use off the reservation. The bank can accept part of an approved period of use and rent it to meet the board’s minimum streamflow rights. General state water supply bank rules apply unless they conflict with this section.
