Clear timelines for terms and board vacancies

A commissioner's term starts on the second Monday of January after the general election. The board must fill any midterm vacancy within 60 days after it has satisfactory proof and must publish a notice with the meeting date, time, and the deadline for qualified electors to apply. The board may declare a seat vacant if a member resigns, is disqualified, refuses, or cannot serve for over 90 days without signed written notice, with satisfactory proof. If remaining members cannot agree on an appointee, the longest‑serving commissioner draws one of the tied names at random. If over 50% of seats are empty, any remaining member or any elector may petition the county commissioners, who must appoint replacements within 60 days; appointees must live in the same subdistrict and serve the rest of the term.

New subdistrict and residency rules for commissioners

The law divides each fire district into three subdistricts at the organizing meeting. The three areas must be as equal as possible in people, area, and miles. Only one commissioner may live in each subdistrict. Commissioners must be voters who lived in the district at least one year and in their subdistrict at least 90 straight days before appointment or election. A county-appointed commissioner under section 31-1408 may finish the initial term even if that puts two commissioners in one subdistrict.
