Hemp growing and shipping allowed

Beginning July 1, 2026, you can grow, process, transport, and research industrial hemp under Idaho’s state plan and the 2018 Farm Bill. The Agriculture Director must issue rules that follow the 2018 Farm Bill. You may move hemp across state lines if you follow Idaho Code 67-2921.

More say and clarity on hemp rules

Starting July 1, 2026, all hemp rules must use negotiated rulemaking, so affected groups can give input. If a proposed state rule is broader or stricter than federal law, the notice must clearly say which parts go beyond federal rules or cover new areas.

New rules for hemp product sales

Beginning July 1, 2026, businesses that sell hemp products for people to eat or inhale must follow Idaho’s hemp rules. This does not cover nonviable hulled hemp seed, hemp seed protein powder, or hemp seed oil. Products must meet the standards in Idaho Code 37-2701(u) and 37-2705(d)(29)(i).

Fees and appeals for hemp violations

Starting July 1, 2026, the Agriculture Department can set fees and penalties for breaking hemp rules. No penalty applies unless you get notice and a hearing under the Idaho Administrative Procedure Act. You can appeal a penalty to the county district court within 30 days of the final agency action.
