Agency sign off required for settlements

Beginning July 1, 2026, the director cannot finalize a settlement or sign a release without written sign off from the affected agency leader or board. If they do not agree, the state board of examiners makes the final decision.

Public notice and hearings on state settlements

Beginning July 1, 2026, when an insurer offers a final settlement, the director sends it to the state controller for publication at least 14 days before acceptance. If the accepted deal changes, the updated agreement is also reported. If a settlement leads to operational changes, the agency must hold a public hearing with a posted agenda, take public comment, and tell the legislature within 7 days.

Stronger checks on big state property claims

Beginning July 1, 2026, for state property claims over $100,000, the director must finish key steps before taking any insurance money. They must get police reports, video, or eyewitness statements if a third party may be at fault. They must get a professional damage review using replacement cost, including soft costs and any code-required upgrades. They must review policy limits and exclusions and confirm no other insurance or bonds apply. Agencies may order their own independent appraisal, and the director must seek the maximum recovery available.

Agency claim reports stay confidential

Beginning July 1, 2026, after the required claim checks, the director gives a findings report to the affected agency and any overseeing board. Lawmakers may review it confidentially. The report is not public until a settlement is reached or the claim closes. This improves internal oversight but limits public access during negotiations.
