Local control kept after districts form

Forming a district does not limit a city or county's normal land‑use powers. Development inside a district still must follow Idaho's Local Land Use Planning Act and local zoning rules. Governments can still set up other districts later or improve and assess land. These rules start July 1, 2026.

District funds only public infrastructure

District financing can pay only for infrastructure that will be publicly owned by the state, a county, or a city. Private owners cannot use district financing. This rule applies starting July 1, 2026.

New rules to form local districts

A city can form a district only inside the city. A county can form one outside a city's plan, or inside it only with that city's consent. Each affected city or county must approve the petition before formation, and the project must have required site approvals under Idaho's Local Land Use Planning Act and local zoning. For phased projects, first‑phase approvals are enough to create the district. These rules start July 1, 2026.
