Beginning July 1, 2026, the law tightens who counts as a PERSI employee. It excludes independent contractors and jobs that do not last five straight months. It excludes sheltered or make-work positions and inmates of state institutions. Students employed by a state school because they are students are excluded. Day-to-day substitute teachers or assistants, not under contract and paid a substitute wage, are excluded. Local seasonal or casual jobs under eight consecutive months, certified as seasonal and weather-affected, are excluded. Jobs eligible for an optional retirement program are excluded, even if part-time or under 20 hours weekly. Someone paying into federal civil service may join PERSI if separately paid for both jobs, under board rules.
Starting July 1, 2026, any employer added to PERSI must follow IRS rules for government retirement plans. This protects the plan’s tax-qualified status and lowers tax risk for members. The requirement applies only to employers added on or after that date.
