Starting July 1, 2026, anyone who knowingly fails to send required notoriety proceeds faces civil penalties. A court can impose up to three times the withheld amount, plus attorney’s fees. The Attorney General can sue to collect these amounts.
Beginning July 1, 2026, anyone who pays an offender for exploiting a crime’s notoriety must send the money to the Idaho State Treasurer. The Treasurer holds it in an interest-bearing escrow for five years and adopts rules to run the program; a court can extend for good cause. Within 30 days of a deposit, the Attorney General notifies known victims. Victims can sue or use restitution during the escrow, and courts can order payment from the account. If several victims win, the court divides funds fairly; after five years and valid claims are paid, remaining money goes back to the offender.
Starting July 1, 2026, the law replaces the old rule and defines what “notoriety” money is and who counts as an offender, including juveniles and people found not guilty by reason of insanity. A crime means any Idaho felony or misdemeanor. It covers cash, royalties, or property paid because of an offender’s public story about the crime, like books, movies, or paid interviews. It does not cover regular wages or income unrelated to the crime, or works that only mention the crime in passing. It also excludes legal fees, money earned before the crime, and normal interview fees for news or documentaries.
