Standard due process for state employees

Beginning July 1, 2026, each department with classified staff has a written problem‑solving procedure that follows uniform HR rules. Employees get notice and a chance to be heard before a dismissal, suspension, demotion, or involuntary transfer takes effect. Staff can file grievances, except broad pay issues and entrance‑probation terminations. After using the department process, employees can appeal to the Idaho Personnel Commission. The uniform rule sets timelines and allows representation and mediation.

Overtime pay and comp time for state workers

Beginning July 1, 2026, agencies decide when overtime is needed. Eligible classified and nonclassified staff get either cash overtime or compensatory time, following federal law. When cash overtime is paid, eligible classified employees are paid 1.5 times their hourly rate. Administrative or professional exempt staff can bank up to 240 hours of comp time; accrual pauses above that cap. Comp time not used by the end of the next half‑fiscal year is paid in cash. Comp time is not transferable and must be paid out when you transfer or leave. Elected officials and employees listed in section 67‑5303(j) do not get cash overtime or comp time. Employees designated as executives do not get cash overtime or comp time and have 12 months to use any existing comp‑time balance.

Uniform vacation rules across state government

Beginning July 1, 2026, eligible nonclassified executive and legislative employees earn and use vacation the same as classified staff. The State Board of Examiners adopts tables so agencies compute vacation time the same way across pay cycles. For nonclassified judicial staff, the Idaho Supreme Court sets accrual rules and must give the state controller 180 days’ written notice before changes. For State Board of Education staff who are outside chapter 53, the Board sets vacation rules and must give the controller 180 days’ written notice.
