The law creates the Idaho High-Needs Student Fund, run by the State Department of Education. It helps school districts and independent public charter schools pay extra costs for a student with a disability whose IEP costs are over $30,000 and not covered by other funds, including school-based Medicaid. The fund covers only IEP-required services like nursing, interpreting, speech, occupational and physical therapy, personal care, specialized equipment, extended school year, and the school-based Medicaid match. It does not cover routine classroom costs, basic supplies, or standard transportation. Money comes from state appropriations, donations, and interest. Beginning July 1, 2026, the program is in effect.
School districts and independent public charter schools can apply each year for approved high-needs students. Applications must list IEP costs and show those costs were not paid by other funds, including school-based Medicaid; the state may ask for more documents. Payments cover 100% of costs between $30,000 and $80,000, then 80% above $80,000, up to $100,000 per student. Each July 1, up to 60% of the fund is reserved for non‑rural LEAs and up to 40% for rural LEAs; any rural set‑aside left on July 1 becomes available to non‑rural LEAs. Applications received by June 1 are paid if the fund has enough money; if not, the state pays each LEA a proportional share. LEAs must use the state’s budgeting, accounting, and reporting system to ensure transparency and avoid duplicate payments.
