Sue for digital ID violations

Beginning July 1, 2026, you can sue if an agency violates these digital ID rules. Courts can order immediate relief and you can recover reasonable attorney's fees and costs. You can get $500 to $2,500 per violation in statutory damages. If the agency knowingly violates the law and, after written notice, does not fix it within 30 days, the court can add a civil penalty up to $5,000 per violation.

Idaho agencies can't force digital ID

Beginning July 1, 2026, Idaho state and local agencies and their contractors cannot require you to get or use a digital ID. They cannot deny, delay, or cut services, licenses, jobs, education, or access because you refuse or can't use one. Physical, non-digital IDs stay valid for all government purposes.

No tracking or sharing of digital IDs

Beginning July 1, 2026, agencies may use a digital ID only to verify identity at that moment. They cannot track you, keep ID data beyond the transaction, or use one shared digital ID across agencies.

ID checks can't search your phone

Beginning July 1, 2026, agencies cannot make you surrender or unlock your phone or device to prove your identity. Showing a digital ID is not consent to search other files or apps. Incidental things seen on your device cannot be used as probable cause for a further search or seizure.
