The law keeps current government powers to investigate from public places. Officials may enter private land to serve legal papers and to do welfare checks when needed. They may also enter during urgent emergencies. Lawful aerial observation remains allowed. Other entries already permitted by Idaho law still apply.
The law does not change how water rights are used or managed. The Water Resources Department or a watermaster may make reasonable entry to do legal duties. Rights of way and easements for ditches, canals, laterals, and drains stay protected.
The law keeps entry powers to control noxious weeds. Abatement district employees can enter land as allowed by law to do public health work. These entries remain lawful to protect health, crops, and property.
The law does not change legal rights for homes or their immediate areas. Protections for your home and the area around it stay the same. Habitation and yard rights remain as before.

H 0889 — STATE PROCUREMENT – Amends, repeals, and adds to existing law regarding the procurement of property by the State of Idaho.
S 1435 — APPROPRIATIONS – HEALTH AND HUMAN SERVICES – Relates to the maintenance appropriations to the Department of Health and Welfare and the State Independent Living Council for fiscal year 2027.
S 1429 — APPROPRIATIONS – HEALTH AND WELFARE – BEHAVIORAL HEALTH SERVICES – Relates to the appropriation to the Department of Health and Welfare for the Behavioral Health Services Division for fiscal years 2026 and 2027.
