Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Shoppers get in-store digital discounts

Stores covered by the law must honor an in-store digital promotion when an eligible shopper meets its terms. The law covers stores where at least 55% of gross sales come from nonprescription medicines and food or drinks for off-site use, if they operate an app for promotions. Stores can choose how shoppers redeem an offer, but must provide its advertised value through a practical method. The law does not require loyalty-program enrollment or offers targeted by program status. Online, delivery, pickup, and other remote sales are excluded.

Stores get 15 days to fix violations

A person can ask a court to order compliance with the Act, and the winning party may recover reasonable legal fees and costs. A violation is a business offense, with a fine of up to $25 per violation and a limit of $500 per person or store each year. Before a fine, the store must receive written notice and 15 days to fix the violation. No fine applies if the store fixes it within that period.

Limits on rules for store promotions

The law generally bars enforcement actions that impose rules, penalties, or fines on stores about prices, discounts, or digital promotions. It also limits rules that restrict stores from offering discounts or incentives with consumer goods. The limits do not override this Act or other federal or Illinois laws that provide otherwise.
