4 provisions identified: 1 benefits, 2 costs, 1 mixed.

More protection for 340B drug access

The law protects Illinois 340B covered entities’ ability to get and deliver 340B drugs through authorized contract pharmacies. No person can restrict which contract pharmacies an entity chooses or demand certain pricing, inventory, or other information. Exceptions apply when a law bars receipt or requires the information or inventory practice. Drug distribution required under federal limited-distribution rules is allowed.

340B drugs tied to recent outpatient care

An Illinois 340B covered entity can dispense or give a patient a 340B drug only when it is connected to outpatient care that patient received within the prior 18 months. This limit may reduce access for patients whose outpatient care was earlier.

Covered entities must prevent duplicate discounts

Each Illinois 340B covered entity must keep a written policy to prevent duplicate drug discounts. The policy must prevent one entity from placing a refill order when another entity will order for the same pharmacy dispense. It must also explain how the entity will repay a manufacturer for a duplicate discount and be filed with the General Assembly every year.

Courts can penalize 340B access violations

The Illinois Attorney General can enforce the law. After finding a violation, a court can order the violator to stop or pay damages to the harmed 340B covered entity. A court can also impose a civil penalty of up to $1,000 per violation or order other relief.
