Broader court power in treatment cases

Circuit courts handle all cases for involuntary outpatient admission under Article VII-A. This outpatient jurisdiction ends on January 1, 2030. Courts also hear cases for people alleged to need treatment under Section 2-107.1, whether or not they face a felony charge. For inmates, cases can start up to 90 days before release, and any order starts when the inmate is discharged. For this rule, inmates are not treated as charged with a felony.

Outpatient mental health orders and safeguards

If a court orders outpatient care, it can place you with a relative or in treatment at a community provider. The program must give humane care in the least restrictive setting that fits your needs. If you do not follow the order, a custodian may be allowed to consent to hospital admission, and the court can authorize a peace officer to take you to a facility. You cannot be held more than 24 hours, not counting weekends and holidays, unless a petition and certificate for inpatient admission are filed within that time. The court can change or revoke orders after a report and notice, and noncompliance alone is not contempt.
