Licensed facilities may operate a cold spa only if they follow the law’s safety and sanitation rules. A cold spa is a basin kept between 40 and 60 degrees Fahrenheit; portable units count only if they meet these rules. Facilities must post clear warnings (including that water cannot be below 40 degrees), ban users under age 14, and provide a visible timer. At least one trained, CPR‑certified employee must be on site, and a thermometer for hypothermia checks must be available. Entrances must have non‑slip surfaces, and water must be continuously filtered or sanitized, or replaced with sanitized water between each use. The health department may set more detailed rules.
No swimming facility can be built or majorly changed until the Illinois Department of Public Health reviews your plans and issues a permit. Permits now last one year from the issue date. To keep a permit active past one year, you must reapply and pay the permit fee. Fees are set by law and must be paid with the application.
