Summary

Amends the Illinois Administrative Procedure Act. In provisions regarding the second notice period for rulemaking, provides that the second notice period shall be extended for a period not to exceed an additional 45 days if the agency has received a statement of unresponsiveness from the Joint Committee on Administrative Rules. Lists the requirements for a statement of unresponsiveness. Provides that failure to provide a substantive response within 7 days after a statement of unresponsiveness is issued shall constitute a withdrawal of the rulemaking. In provisions regarding the contents of the written notice to the Joint Committee, requires a statement certifying that no procedure, policy, schedule, or other feature of the agency will prevent the agency from substantively engaging with the Joint Committee regarding suggestions made during the second notice period.

Clear timelines for state rule reviews

The second notice to the Joint Committee on Administrative Rules starts when the committee gets the agency’s notice and lasts 45 days. The agency and the committee may agree to extend that review by up to 45 days, and agree once more to extend it up to another 45 days. After the second notice starts, agencies cannot make substantive changes unless JCAR objects or suggests them. After the review ends and any objections are answered, the agency must file the adopted rule for publication. A rule takes effect when filed, unless a statute or the rule sets a later date. Agencies must adopt and file a rule within one year of the first notice start; time when rulemaking is legally barred and the second extension period do not count toward that year.

More time and voice on Illinois rules

Beginning July 28, 2023, agencies must give at least 45 days of public notice before adopting or changing a rule. The notice includes the rule text, the law that allows it, and a clear description of the issues. Agencies must accept written comments, including by email or a public website. A hearing is required if, within 14 days, 25 people, an association of 100, the Governor, the Joint Committee on Administrative Rules (JCAR), or an affected local government asks. Hearings are open, recorded, and allow public questions. If a study is used, the notice must name it and its author, and agencies must share the study data on request unless FOIA protects it.

Small-business impact reports for new rules

Beginning July 28, 2023, agencies must write an initial small‑business analysis for every proposed rule. It lists the types of small businesses affected, the reporting and bookkeeping needed, and the skills to comply. When sending the rule to the Joint Committee on Administrative Rules, agencies must include a final analysis that addresses small‑business feedback and alternatives. Agencies must send the final analysis to each small business that commented and to anyone who asks. They may charge a reasonable postage or handling fee for copies.
