Summary

Amends the Radioactive Waste Storage Act. Provides that interest earned by the investment or deposit of moneys accumulated in the fund pursuant to the settlement agreement in the matter of the State of Illinois, et al. v. Teledyne, Inc., shall be deposited into the Radioactive Waste Site Perpetual Care Fund for the continued maintenance of the Sheffield Low-Level Radioactive Waste Site and the surrounding buffer zone. Effective immediately.

Perpetual care funds for waste sites

The law creates a special state fund for radioactive waste site care. Fees paid under IEMA-OHS contracts go into this fund, and the money pays for ongoing monitoring and maintenance to protect health and safety forever. It also requires payments from the May 25, 1988 Teledyne settlement to stay in a separate Sheffield fund. Interest stays in that fund. That money is used only as the settlement allows to maintain the Sheffield site and its buffer zone on a perpetual basis.

State takes ownership of waste sites

The State buys any land named for radioactive waste storage and keeps it forever. When the Illinois Emergency Management Agency’s Office of Nuclear Safety (IEMA-OHS) accepts waste for permanent storage, the State becomes the owner of that waste. IEMA-OHS manages, controls, and can dispose of the waste in the State’s name. These rules protect public health and safety on a permanent basis.
