Domestic workers are employees under Illinois minimum wage law. This applies even if the household has fewer than four employees. When an employer hires any worker on any day in a year, it is covered from that day through the rest of that year and the next year. Workers for employers with fewer than four employees are otherwise not covered. The headcount ignores the owner’s parent, spouse, child, or other immediate family.
Tips and employer-provided meals or housing you actually use count as wages. The Director of Labor sets how tips are counted. These amounts can be used to meet wage rules.
A day camp is a seasonal program that runs no more than 16 weeks in a year, serves five or more children, and has no overnights. Licensed day care agencies, child-care facilities, and foster family homes are not day camps. This definition helps decide if camp staff are covered by minimum wage rules.
